2. Restriction on Waqf Creation: It stipulates that only individuals who have been practicing Islam for at least five years can declare a waqf, aiming to ensure the authenticity of such endowments. 



3. Removal of 'Waqf by User': The bill eliminates the concept of 'waqf by user,' which recognized properties as waqf based on long-term use for religious purposes, to address ambiguities in property recognition. 



4. Government Oversight in Property Disputes: It grants government authorities, specifically District Collectors, the power to determine the status of disputed waqf properties, aiming to streamline dispute resolution.

Controversies and Criticisms:


The proposed amendments have sparked significant debate:


Threat to Muslim Property Rights: Critics argue that including non-Muslim members and increasing government oversight could undermine the autonomy of waqf institutions and potentially lead to the confiscation of historic religious sites lacking formal documentation. 


Discriminatory Provisions: The restriction allowing only long-term practitioners of Islam to create waqfs is seen as discriminatory against recent converts, potentially violating constitutional rights to equality.

Current Status:


As of April 3, 2025, the Lok Sabha has passed the bill with 288 votes in favor and 232 against. It now awaits consideration in the Rajya Sabha and requires presidential assent to become law.

वक्फ (संशोधन) विधेयक, 2024 भारत में वक्फ अधिनियम, 1995 में बदलाव के लिए लाया गया है। यह विधेयक वक्फ संपत्तियों (इस्लामिक धार्मिक या दान स्वरूप संपत्तियाँ) के प्रशासन और प्रबंधन से संबंधित है।


मुख्य प्रावधान:


1. ग़ैर-मुस्लिम सदस्य भी होंगे शामिल – केंद्रीय वक्फ परिषद और राज्य वक्फ बोर्ड में ग़ैर-मुस्लिम सदस्यों को शामिल करने का प्रस्ताव है।

3. 'वक्फ बाय यूजर' हटाया गया – किसी संपत्ति को वक्फ संपत्ति घोषित करने का पुराना नियम (जो लंबे समय से धार्मिक उपयोग में आने वाली संपत्तियों को वक्फ मानता था) समाप्त कर दिया गया है।



4. सरकार को अधिक अधिकार – जिलाधिकारियों (कलेक्टर) को वक्फ संपत्ति के विवादों को हल करने का अधिकार दिया गया है।



5. डिजिटल रिकॉर्ड – वक्फ संपत्तियों का डिजिटल रिकॉर्ड तैयार करने का प्रावधान किया गया है।




विवाद और आलोचना:


मुस्लिम संपत्तियों को खतरा – आलोचकों का मानना है कि ग़ैर-मुस्लिम सदस्यों को वक्फ बोर्ड में शामिल करना और सरकारी हस्तक्षेप बढ़ाना वक्फ की स्वायत्तता (Autonomy) को प्रभावित कर सकता है।


संवैधानिक अधिकारों का उल्लंघन – 5 साल से इस्लाम अपनाने की शर्त को लेकर धार्मिक भेदभाव की बात उठाई जा रही है।


सरकार का हस्तक्षेप बढ़ेगा – जिलाधिकारियों को वक्फ संपत्तियों पर निर्णय लेने का अधिकार देने से, कुछ लोगों को सरकारी पक्षपात (Bias) की आशंका है।



वर्तमान स्थिति:


3 अप्रैल 2025 को लोकसभा में यह विधेयक 288 वोटों से पास हो गया, जबकि 232 सांसदों ने विरोध किया। अब इसे राज्यसभा में मंजूरी और राष्ट्रपति की सहमति की आवश्यकता है।
